1. Our self-image

LIK Academy for Photography and Design is a private school for photography, film and media professions in the field of adult education. We understand education as a social responsibility and act according to clear criteria of quality, transparency and inclusion.

We are a leading, internationally networked centre of excellence for visual media. We are continuously strengthening our role as a modern, inclusive and labour market-oriented vocational school with high pedagogical quality and innovative learning formats.

We offer professional full-time training courses, part-time programmes and flexible online/on-demand formats. In addition, we are expanding our range of courses to include English-language courses in order to involve international participants and promote learning mobility.

Since 2025, we have had Erasmus+ partnerships that strengthen European exchange and international project cooperation.

GENERAL TERMS AND CONDITIONS LIK ACADEMY FOR PHOTOGRAPHY AND DESIGN

1. GENERAL

LIK Academy for Photography and Design Ltd. offers comprehensive training in photography, film, image editing and media design. After two years of training at LIK Academy for Photography and Design, participants have the option of completing a Top Up Bachelor of Creative Media degree at a partner institute.

The part-time diploma courses in photography, photo design/image editing, portrait photography, film, social media, online marketing, media design and other media training, courses and classes each last two semesters and cover all topics related to modern photography and effective photo editing, media design, marketing and film and media design, and media communication.

All courses can be attended independently of each other on a part-time basis or as part of vocational training, but can also be completed simultaneously. The courses offered by the LIK Academy for Photography and Design are tailored to aspiring professional photographers, dedicated photographers and people seeking training in the graphic arts and media professions.

The photography and media design courses teach technical knowledge as well as creative visual training. The focus is on practical photography and teaching photographic skills. Creativity training and a professional, commercial and artistic approach to photography round off the programme.

The LIK Academy for Photography and Design offers professional full-time vocational training at a high technical and didactic level, which facilitates entry into professional life. Professional internships are carried out during the training period.

In addition, courses and seminars are offered on site and online with a duration of less than two semesters. In this case, the course duration will be announced separately in the advertisement.

Online distance learning courses and training programmes take place online with or without attendance times.

The participation fee does not include the costs of films, photo processing, photo paper, chemicals, any entrance fees, travel expenses, accommodation and meals.

2. SCOPE

LIK Academy for Photography and Design Ltd. provides its services exclusively on the basis of the following General Terms and Conditions (hereinafter referred to as ‘GTC’). They therefore apply to all events and locations of the LIK Academy for Photography and Design.

The GTC govern the contractual relationship between the participants of an event and LIK Academy for Photography and Design as the organiser. Deviations from the GTC or other agreements and subsidiary agreements that contradict these GTC require the express written approval of LIK Academy for Photography and Design to be valid.

The General Terms and Conditions also apply to all future business relationships, even if this is not agreed separately and no express reference is made to the General Terms and Conditions.

Should individual provisions of the General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions and the contracts concluded on the basis thereof. The invalid provision shall be replaced by a valid provision that comes closest to its meaning and purpose.

Any deviating terms and conditions of participants shall not be valid unless expressly confirmed in writing by LIK Academy for Photography and Design.

Insofar as personal terms are used in these General Terms and Conditions, they apply equally to all genders.

3. AMENDMENTS TO THE TERMS AND CONDITIONS

LIK Academy for Photography and Design has the right to amend the provisions relating to the services to be provided at its reasonable discretion, taking into account general requirements and market conditions, insofar as this is reasonable for the participants.

Amendments to these General Terms and Conditions will be published on the website, which is freely accessible on the Internet. Participants will be informed in writing (by letter or email) of any amendments to the General Terms and Conditions that are not covered by the first paragraph of this point.

The amendments shall take effect unless the participants object to them within 14 days of receiving notification of the amendments.

4. COURSE LOCATION

All courses/classes take place (unless another course location is specified) at 1070 Vienna, Seidengasse 17 or Spittelberggasse 9 or Abensbergstrasse 4, 4061 Pasching.

5. REGISTRATION/CONCLUSION OF CONTRACT

The offers of the LIK Academy for Photography and Design are non-binding and subject to change.

Registration at the LIK Academy for Photography and Design is possible at any time. Registration is only possible by email to anmeldung@likakademie.at using the online form.

By registering at the LIK Academy for Photography and Design, participants submit a binding contract offer and accept the validity and applicability of these General Terms and Conditions to the respective contractual relationship.

Upon receipt of the registration confirmation by the LIK Academy for Photography and Design, the contract between the LIK Academy for Photography and Design and the participants becomes legally effective on the basis of the General Terms and Conditions.

The confirmation of participation will be sent to the participants by email. Please note that confirmations may also be found in the spam folder of the participant's email account and should therefore be checked by the participant.

Places are allocated in the order of registration, whereby the first instalment of 20% of the tuition fees must be paid within 7 days of registration. The remaining 80% of the tuition fees must be paid no later than 14 days before the start of the course. Invoices are issued per semester. Participation is only guaranteed once the full participation fee has been received in the account of the LIK Academy for Photography and Design.

Registration for the course is binding for two consecutive semesters and cannot be cancelled after the course has started. Participants cannot therefore reclaim either part or all of the tuition fees they have paid to the LIK Academy for Photography and Design.

As in the courses, participation in the second semester of the master class and summer academy is also mandatory, unless expressly agreed otherwise.

When registering for a course, there is an agreement between the participants and LIK Academy for Photography and Design that invoices will be accepted in digital form as PDF files. No paper invoices will be sent.

Late registration for courses that have already begun does not entitle the participant to a reduction in tuition fees.

Missed lessons cannot be made up for organisational reasons.

6. COURSE / PROGRAMME

All courses and classes are conducted according to the timetable. The current timetable is published online: www.likakademie.com.

Diploma courses, degree programmes and courses, unless otherwise specified in the announcement, are held over two semesters.

For full-time education, the holiday regulations of the City of Vienna schools apply. Other courses: Classes take place according to the timetable.

For weekend seminars, courses and training courses, meals and accommodation are not included in the tuition fees.

7. FEES / PAYMENT

A participation fee is payable for attending the course. The applicable prices are listed in the course description on the homepage of the respective course offering. A summary of all courses and training programmes can be found at www.likakademie.com. Please note that the prices at the time of the respective order/course registration are decisive.

Course participants will receive an invoice by email upon registration. Payment must be made by bank transfer to the bank account specified by the LIK Academy for Photography and Design.

The course fee must be received in the account of the LIK Academy for Photography and Design no later than 14 days before the start of the course. In the event of late payment, the LIK Academy for Photography and Design reserves the right to charge the invoice recipient default interest at a rate of 12% p.a.

8. CANCELLATION BY PARTICIPANTS

Cancellation of a course at the LIK Academy for Photography and Design is only valid if it is received in writing (by post) by the LIK Academy for Photography and Design at Spittelberggasse 9, 1070 Vienna in good time. Cancellation by email or any other means will not be accepted by the LIK Academy for Photography and Design and is therefore not valid.

Cancellation without a cancellation fee is possible up to two months before the start of the course. If cancellation occurs within one month before the start of the course, the deposit (20% of the tuition fee for the first semester) will be retained as a cancellation fee. The cancellation costs incurred from cancellation within one month are calculated according to the type of course and training. The latest date for cancellation is the third working day before the start of the course. After that, the full course fee will be charged.

Approximately 5-14 days (depending on the course) before the start of the course, personal access to the LIK Online Moodle learning system and thus to all LIK course materials and handouts from the LIK Academy for Photography and Design will be activated. For copyright reasons and to prevent misuse, the entire course fee is due from this point onwards (personal access code via email), regardless of other deadlines. Exceptions are made in cases of ‘force majeure’, such as illness, accident, etc., upon presentation of appropriate evidence. However, the course/training fee can only be waived if the LIK Academy for Photography and Design has saved expenses as a result of the absence due to ‘force majeure’. Participants are free to provide evidence that the organiser has saved expenses as a result of the cancellation.

Other reasons (dissatisfaction, programme changes, date changes, changes to venues, changes to course content, teaching staff, technical problems with personal devices, switch to online teaching) do not entitle participants to a refund. Participants cannot derive any claims against the LIK Academy for Photography and Design from a change or cancellation.

It is not possible to deregister from the second semester of the course (even if this is submitted before the start of the semester), as registration is valid for two consecutive semesters and the deregistration deadlines therefore refer to the start of the course and not to the start of the semester. As the place at the LIK Academy for Photography and Design cannot be filled in the second semester, the entire semester fee must be paid even if the second semester is not attended.

9. CONFIRMATION OF IMPLEMENTATION

14 days before the start of the course by the LIK Academy for Photography and Design. If the minimum number of participants has not been reached by this date, point 11 of the General Terms and Conditions shall come into effect.

10. CHANGES TO THE EVENT PROGRAMME

The LIK Academy for Photography and Design expressly reserves the right to change course content, venues and dates.

11. NUMBER OF PARTICIPANTS

A prerequisite for the LIK Academy for Photography and Design to hold an event is that the minimum number of participants is reached. The minimum number of participants is set by the LIK Academy for Photography and Design. This is at the sole discretion of the LIK Academy for Photography and Design. If this number is not reached, the event cannot take place. The minimum number of participants is determined at the discretion of the LIK Academy for Photography and Design

. If the minimum number of participants is not reached, the LIK Academy for Photography and Design is entitled to withdraw from the event. It must notify the participants of its withdrawal no later than 3 days before the start of the event. The LIK Academy for Photography and Design is also entitled to withdraw in the event of illness or incapacity of the speaker, as well as for other important reasons for which the LIK Academy for Photography and Design is not responsible. In the event of withdrawal, participants will be refunded all participation fees already paid. Participants cannot assert any claims of any kind beyond this.

No waiting lists will be kept. For organisational reasons, it is not possible to make a non-binding reservation for the course.

12. CANCELLATION OF COURSES BY THE LIK ACADEMY FOR PHOTOGRAPHY AND DESIGN

If the minimum number of participants is not reached, the participants will be informed by the LIK Academy for Photography and Design. This does not result in any obligations for the LIK Academy for Photography and Design. The LIK Academy for Photography and Design reserves the right to cancel in good time.

If a course/class at the LIK Academy for Photography and Design is cancelled, participants will receive a full refund or credit for the course fee they have paid. Alternatively, participants may rebook. If the replacement course is more expensive than the original course, the difference must be paid; if the replacement course is less expensive, participants will be credited with the difference.

In the event of a course being cancelled due to force majeure and/or legally mandated measures, including pandemic measures, participants cannot assert any claims (of any kind) against the LIK Academy for Photography and Design for costs incurred of any kind (in particular: travel expenses, loss of working hours, etc.).

Course dates are subject to the availability of appropriate teaching staff. If a teacher is unable to attend, the LIK Academy for Photography and Design shall provide a substitute teacher. Replacement lessons shall be offered for cancelled lessons. If this is not possible in individual cases, the course fee attributable to the cancelled lesson shall be refunded on a pro rata basis. There is no entitlement to instruction by a specific teacher; a change of teacher does not entitle participants to withdraw from the contract in whole or in part.

13. INSTRUCTION

One teaching unit (TU) lasts 50 minutes. The time frame specified in the programme includes a 10-minute break per teaching unit.

In order to ensure that the course objectives are achieved, the management of the LIK Academy for Photography and Design reserves the right to exclude persons who persistently disrupt lessons from the course without refunding course fees. Exclusion from the course is possible without giving reasons.

14. COMPLETION

A minimum of 75% attendance and a positive final examination are required for successful completion. The content of the final examination is determined in the syllabus for the respective course.

Participants who have only attended the course to a limited extent will not receive a certificate of attendance. This also applies if the course has been paid for by the participants.

Participants are not entitled to claim that they have mastered the course content after attending the course. The LIK Academy for Photography and Design is therefore not liable for the achievement of a specific learning or course success. No liability claims can be asserted by participants against the LIK Academy for Photography and Design arising from the application of the knowledge acquired at the LIK Academy for Photography and Design.

15. PROVISION OF INFORMATION BY THE LIK ACADEMY FOR PHOTOGRAPHY AND DESIGN

As the organiser, the LIK Academy for Photography and Design endeavours to provide accurate information in its courses and to convey this to participants.

However, the LIK Academy for Photography and Design does not guarantee or accept liability for the accuracy, timeliness or completeness of the information it provides.

16. RIGHTS OF USE

The photos of participants submitted or taken during the event/course/training may be used and published by the LIK Academy for Photography and Design for reporting purposes without restriction. This applies in particular to publication or distribution on the homepage of the LIK Academy for Photography and Design, exhibitions or other communications. Publication or distribution may take place without restriction in terms of time or location, provided that a copyright notice is included. The LIK Academy for Photography and Design is also entitled to make minor corrections to the photos of the participants without their further consent if this is deemed necessary by the LIK Academy for Photography and Design.

Participants also consent to publication if they themselves are depicted in ‘making-of photos’ and are recognisable as a result.

The photos and film recordings made during LIK Academy events may not be used commercially by participants and may only be published with a clear reference (taken during the event/training at the LIK Academy for Photography and Design).

All photos submitted by course participants to the LIK Academy for Photography and Design must be free of third-party rights. In the event of a violation, participants shall indemnify and hold harmless the LIK Academy for Photography and Design. The LIK Academy for Photography and Design is not liable for the loss of submitted image material.

Scripts and documents: Please also note the copyright of the LIK Academy for Photography and Design course materials. Distribution or publication is not permitted. Use is only permitted to course participants within the scope of the course.

Failure to comply will result in legal action.

17. NON-COMPETITION

LIK graduates are also not permitted to offer photographic training themselves within 3 years or to work as trainers at another training institute in the LIK Academy for Photography and Design training area.

18. INTELLECTUAL PROPERTY

The entire content of the courses/workshops/training courses/all courses is subject to copyright protection, industrial property rights and other laws protecting intellectual property. The information may only be used for personal use. Any other use, in particular reproduction, transmission, distribution, modification, republication or presentation, even in part, is expressly prohibited. It may only be carried out with the written permission of the LIK Academy for Photography and Design. Some teaching materials contain images whose rights have been acquired from third parties for use in the course only.

All images created in the course of the courses may only be used for private or self-promotional purposes with the note ‘created as part of the training at the LIK Academy for Photography and Design’; Any commercial use is prohibited.

If a model is available as part of a course/workshop/training programme, a model work contract between the model and LIK Academy for Photography and Design GmbH applies, in which the exploitation rights are agreed separately.

The LIK Academy for Photography and Design advises participants to respect the applicable personal rights and, in particular, the right to their own images of colleagues.

19. DATA PROTECTION

For organisational reasons, LIK Academy for Photography and Design stores personal data such as names, addresses and course bookings of LIK participants. Participants' data is treated confidentially. This data is only transferred to third parties within the framework of the statutory provisions. By registering or submitting their data, participants consent to the storage of all personal data.

Participants agree to receive electronic mail from the LIK Academy for Photography and Design. The sending of such mail can be stopped at any time by the participant revoking their consent to the LIK Academy for Photography and Design.

20. ELECTRONIC RECORDINGS

During lectures and workshops, participants are not permitted to make recordings or film on tape or using other electronic devices. Film and sound recordings or any screening (broadcasts, etc.) of lessons in the rooms of the LIK Academy for Photography and Design are strictly prohibited. This is only permitted with the express written confirmation of the LIK Academy for Photography and Design. Illegally made recordings must be deleted immediately and irrevocably.

21. LIABILITY / LIMITATION OF LIABILITY

Participants must treat the teaching materials provided by the LIK Academy for Photography and Design with care and respect. Any damage or malfunctions must be reported immediately to a representative of the LIK Academy for Photography and Design.

The liability of the LIK Academy for Photography and Design is limited exclusively to damage caused by intent or gross negligence on the part of the LIK Academy for Photography and Design and its vicarious agents.

Participation in the events, courses, workshops, seminars and training courses of the LIK Academy for Photography and Design is at the participants' own risk. Liability for accidents or other damage to participants or third parties during all events is only assumed within the scope of statutory liability.

Participation in excursions, guided tours, outdoor courses and trips is at your own risk.

The LIK Academy for Photography and Design is not liable for loss, theft or damage to technical devices and personal equipment that participants bring to the event. This also applies to other valuables and teaching materials. The LIK Academy for Photography and Design recommends that participants refrain from bringing expensive valuables to the courses.

The LIK Academy for Photography and Design is not liable for personal injury during the event.

The LIK Academy for Photography and Design is not liable for inadequate event content, teaching methods, unachieved learning objectives, technical failures or other omissions and disruptions.

This also applies to services provided by third parties that are offered to participants during the event.

The LIK Academy for Photography and Design is not liable for exceeding maximum group sizes caused by rebookings, etc. Group sizes may vary depending on the teaching content. The teaching content is also tailored to the individual participants. In the event of withdrawal from an event, the LIK Academy for Photography and Design is not liable for any other expenses (e.g. accommodation costs, travel expenses, etc.) incurred by participants in relation to the event.

22. APPLICABLE LAW / PLACE OF JURISDICTION

Austrian law applies exclusively, excluding international referral rules and the UN Convention on Contracts for the International Sale of Goods.

The place of performance is Vienna. For legal disputes, the jurisdiction of the relevant court in 1010 Vienna is agreed.

23. RIGHT OF WITHDRAWAL/CANCELLATION

As a consumer, you have the right to withdraw from this contract within 14 days without giving any reason by means of a clear statement (e.g. a letter sent by post, fax or email) informing us of your decision to withdraw from the contract.

You can use the attached sample withdrawal form for this purpose, but this is not mandatory. To comply with the withdrawal period, it is sufficient to send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Once the course has started, it is not possible to withdraw from the contract and the entire course fee is due in accordance with the General Terms and Conditions of the LIK Academy for Photography and Design, as all teaching materials and internal information have already been created and distributed and, where applicable, student ID cards have been issued.

24. CONSEQUENCES OF WITHDRAWAL

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract.

We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

Once the course has started, it is not possible to withdraw from the contract and the entire course fee is due in accordance with the terms and conditions of LIK Akademie GmbH, as all teaching materials and internal information have already been prepared and distributed and, where applicable, student ID cards have been issued.

You can use the attached sample withdrawal form for this purpose, but this is not mandatory.

To comply with the withdrawal period, it is sufficient to send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal:

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.

Google Analytics

We use the functions of the web analysis service Google Analytics on our website to analyse user behaviour and optimise our website. This service is provided by Google Ireland Limited, Barrow Street, Dublin 4, Ireland (‘Google’). Information about the use of the website, such as browser type/version, operating system used, the previously visited page, host name of the accessing computer (IP address), time of the server request, is usually transmitted to a Google server and stored there. We have concluded a contract with Google for order processing in accordance with Art. 28 GDPR.

On our behalf, Google will use this information to evaluate the use of our website, to compile reports on the activities within our website and to provide us with further services related to the use of our website and the internet. According to Google, the IP address transmitted by your browser will not be merged with other Google data.

We only use Google Analytics with IP anonymisation enabled by adding the code ‘anonymizeIP’ to this website. This guarantees that your IP address is masked so that all data is collected anonymously. Cooperation with processors

We carefully select our service providers who process personal data on our behalf. If we commission third parties to process personal data on the basis of a data processing agreement, this is done in accordance with Art. 28 GDPR.

Transfer to third countries

If we process data in a third country or if this occurs in the context of using third-party services or disclosing or transferring data to other persons or companies, this is only done for the reasons stated above for the transfer of data.

Storage period

If no explicit storage period is specified at the time of collection (e.g. in the context of a declaration of consent), we are obliged under Art. 5(1)(e) GDPR to delete personal data as soon as the purpose for processing has been fulfilled. In this context, we would like to point out that statutory retention obligations constitute a legitimate purpose for the processing of personal data.

  • pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data, unless the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to have it deleted and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have objected to the processing pursuant to Art. 21 GDPR;

  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request its transfer to another controller;

  • pursuant to Art. 21 GDPR, if your personal data is processed on the basis of our legitimate interest, to object to the processing of your personal data, provided that there are reasons for this arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection, which we will implement without you having to specify a particular situation.

  • pursuant to Art. 7(3) GDPR, to revoke your consent at any time. As a result, we will no longer be permitted to continue processing data based on this consent in the future. Gender mainstreaming focuses on equality and the advancement of women. The LIK Academy for Photography and Design strives to be a place of diversity and equality for all students, where discrimination is not an issue because it does not occur. In fulfilling its tasks, the LIK Academy for Photography and Design is actively and visibly committed to offering students and staff equal opportunities, regardless of gender, age, religion, ethnicity, sexual orientation or social background. Within the scope of its activities, the LIK Academy of Photography and Design contributes to actively eliminating existing disadvantages in society and to creating learning and working environments in which diversity and variety play an enriching role. The LIK Academy for Photography and Design strives for a balanced ratio of women and men and is committed to equality as required by the Austrian Equal Treatment Act in the fulfilment of its tasks.
